New York State Insurance Laws?

Question: I posted a question on here a week ago asking about car insurance companies and accidents but I am still dealing with this and was hoping for some advice or direction. To make a long story short my girlfriend was driving straight on a road when this girl made an illegal left turn out of a bank and her and my girlfriend collided. Now the other girls insurance is taking responsibility (Allstate). But they are offering us money and saying the car is totaled. Is there a site that I can see what the insurance companies’ responsablities are for this? Let’s say I want the car fixed why can't I make them fix it if they are claiming responsibility? I just need to know what my rights are and if I can fight any of this.

Answer: For damage to the car, their liability is to either fix the car or pay you the value of it. Their choice. You can always buy the car from the wrecker and fix it yourself withthe insurance money, but it probably is not worth it, since the insurance people would have done this if it was cheaper.

I let my friend drive my car, but i have no insurance and neither did she. we were hit by another car?

Question: So i was in the passenger side of my car, she was driving. I have no car insurance. I was teaching her how to drive a five speed stick. she did great. we go around the same curve we go around everyday. i see the other car and yelled out car! we were doing about ten miles an hour still in first gear because we had just came from stopping at a stop sign. the other girl driving is texting ( i can see her phone light because it was dark out side ) we come to a complete stop and the other girl still hit us because (im guessing) she didnt look up from her phone to see us, but she had to see our headlights. I got out of the passenger side and i am in the ditch from where my friend got over as far as she could. the other girl is in the middle on the road on our side. she has insurance but i dont and niether does my friend. cops came and, of course, talked to the other girl first. let her leave then talked to us. my friend got a ticket for the insurance and he said nothing will happen to me. she got insurance the next day. anyways Will the other girls insurance company pay to fix my car? i have pictures on my facebook of it, search Savvy Reese and it also shows where my car is so close to the ditch and the other girl is in the middle of the road so let me know.. my other friend got hit and she didnt have insurance but the other person did. she got a five hundred dollar check from the other guys insurance company. help?

Answer: Maybe not. If you live in a "no pay no play" state like Louisana, when your car is uninsured, you can't collect from the other person's policy, either. So it's going to depend mostly, on what state the accident happened in.
